Hublyd Terms of Use

These Terms of Use govern access to and use of the Hublyd website, application and services. They must be accepted when creating an account, including for a free plan. The commercial conditions applicable to paid subscriptions are set out in the Terms of Sale.
1. Definitions
Hublyd means the company HUBLYD, publisher of the platform. Services means the website, application, platform, features, interfaces, content and tools made available by Hublyd. Client means any legal entity or person acting for professional purposes who creates or manages a Hublyd Organisation. User means any person authorised to access the Services, including an owner, administrator, editor, viewer or guest. Organisation or Space means the environment created by a Client within Hublyd. Client Content means data, client references, documents, files, texts, logos, images, testimonials, client cases, presentations and information imported or generated via the Services.
2. Purpose of the Services
Hublyd is a web platform for the shared management of client references, enabling their promotion in various output formats including LinkedIn content, presentations, commercial documents and content translated or adapted using artificial intelligence features. The Services include in particular the storage of references, collaboration between users, content generation or adaptation, document creation, data export and the use of certain third-party services required for the platform to operate. The Services are intended for professionals, companies, associations, public bodies, schools, independent contractors and organisations. The French version of the contractual documents prevails in the event of translation.
3. Acceptance and relationship with the Terms of Sale
Access to the Services implies acceptance of these Terms of Use. When subscribing to a paid plan, the Client must also accept the Terms of Sale. The Terms of Use govern the technical and functional use of the Services; the Terms of Sale govern the commercial, payment, subscription and contractual liability conditions applicable to paid plans. In the event of conflict between the documents, the specific conditions accepted in writing by Hublyd prevail, then the Terms of Sale for commercial aspects, then the Terms of Use for usage aspects.
4. Account creation and authentication
An account is created from the Hublyd authentication page. Users may also sign in via Google where this option is available. In such cases, use of Google's authentication service remains subject to Google's terms and policies. The user undertakes to provide accurate, complete and up-to-date information. The user is responsible for the confidentiality of their authentication credentials and must notify Hublyd immediately of any unauthorised access, suspected compromise or fraudulent use of their account. Hublyd may temporarily suspend access to an account or Organisation in the event of a security risk, suspected fraud, unauthorised access, misuse, breach of the Terms of Use or a request from a competent authority.
5. Organisation, roles and Client responsibility
Each new Client creates an Organisation of which they are the owner. The owner or administrators may invite collaborators, assign roles and define access rights, including the roles of administrator, editor and viewer. The Client is solely responsible for the users they invite, the rights they assign to them, the shares made, the exports carried out and the actions performed within their Organisation. Actions by internal, external or guest users are deemed to have been carried out under the Client's responsibility. Hublyd is not responsible for configuration errors, deletions, modifications, shares, publications, exports or transmissions made by the Client, their administrators, users or guests.
6. Private API, automated access and technical restrictions
Unless otherwise agreed in writing or covered by specific documentation, no public API is made available. Any private API, technical endpoint or internal interface may only be used under conditions expressly authorised by Hublyd.

8. Client content, references, logos and third-party rights
The Client retains ownership of their Client Content. Hublyd acquires no ownership rights over content imported, stored, entered, generated or exported by the Client. The Client warrants that they hold all rights, authorisations, licences and consents necessary to import, store, process, share, translate, adapt, publish, export or exploit via the Services the client references, names, logos, trademarks, testimonials, quotes, client cases, images, documents, figures, files and information they enter. The Client is solely responsible for the accuracy, lawfulness, confidentiality, relevance and currency of their Client Content. Hublyd does not validate references, testimonials, logos, client cases or commercial results added by the Client. The Client grants Hublyd a non-exclusive, worldwide, royalty-free licence limited to hosting, displaying, technical reproduction, processing, securing, maintaining, supporting, debugging and operationally improving the Services, solely to the extent necessary to provide the Services.
9. Sensitive data and prohibited content
Unless Hublyd has given prior written consent, the Client must not process or transmit via the Services any sensitive data, health data, biometric data, criminal data, data relating to minors, critical trade secrets or data subject to specific restrictions. Hublyd may suspend or restrict access to the Services if such content is detected or reported, in order to protect users, third parties, platform security and legal compliance.
10. Confidentiality of Client content
Hublyd undertakes not to access, view, use, disclose or share Client Content for commercial, marketing or external communication purposes, except with the Client's express consent, for technical necessity related to the provision of the Services, at the Client's request for support, for security purposes, legal obligation or defence of its rights. Hublyd acknowledges that certain Client Content may be subject to confidentiality obligations, including non-disclosure agreements between the Client and their own clients. The Client remains responsible for verifying that they are authorised to process such content via Hublyd.
11. Artificial intelligence features
The Services may integrate third-party artificial intelligence platforms, algorithms or models, in particular OpenAI, to generate responses, suggestions, translations, reformulations, drafts, analyses, materials or other outputs from content or instructions provided by the user. Certain Client Content may be transmitted to OpenAI or another AI provider solely to deliver the feature requested by the user. Hublyd does not use Client Content to train its own artificial intelligence models and commits to configuring its AI providers so that transmitted content is not used to train their models where this contractual or technical option is available. Outputs generated by artificial intelligence are working proposals. They may be incomplete, inaccurate, inappropriate, irrelevant, biased, poorly translated or ill-suited to the context. The Client and users must verify, correct and validate them before any internal or external use. Hublyd provides no guarantee of any commercial, contractual, financial or operational result from the use of artificial intelligence features. AI features must not be used as the sole basis for critical or legally binding decisions.
12. Translations, presentations, exports and formats
Hublyd may allow the generation or export of content, in particular in the form of documents, presentations, LinkedIn content, translations or Excel files. Available exports may evolve depending on plans, features and Hublyd's technical choices. Translations, reformulations, adaptations or generated content may contain errors, approximations or variations in meaning. The Client must review and validate them before any distribution, publication, presentation or transmission to a third party. Hublyd does not guarantee that imported or exported documents will identically preserve their formatting, structure, animations, fonts, graphic elements, notes, comments or metadata, in particular when exporting to PowerPoint, Excel or any other format.
13. Third-party services and content
The Services may rely on third-party providers including Vercel, Railway, Neon, Cloudflare, Cloudflare R2, OpenAI, Stripe, Doppler, Unsplash, OpenCage and Google Login. These providers may be involved in hosting, database, storage, DNS, security, authentication, payment, secrets management, geocoding, image provision or AI features. Hublyd shall not be liable for interruptions, limitations, errors, modifications, slowdowns, unavailability or changes in conditions attributable to third-party services, subject to the mandatory obligations applicable to it. Images or content provided by third-party libraries such as Unsplash may be subject to the terms of those services. The Client is responsible for verifying their suitability for the intended use, in particular commercial use.
14. Availability, backups and critical use
Unless an SLA is expressly applicable to certain paid subscriptions, the Services are provided without any guarantee of continuous availability. Free plans, free trials, beta versions or experimental features are not covered by any SLA. The Client acknowledges that the Services are not intended for use as a critical system, sole fallback system, essential infrastructure or solution whose unavailability could cause serious harm, major commercial loss or an inability to fulfil an essential obligation of the Client. It is the Client's responsibility to make appropriate backup, export, duplication or continuity arrangements for their own constraints, in particular before an event, trade show, client meeting, presentation, commercial negotiation, tender or closing.
15. Fair use and unlimited plans
Where certain features are presented as unlimited, this is within the framework of reasonable, fair use consistent with the normal purpose of the Services. Hublyd reserves the right to limit, suspend or restrict manifestly excessive, abusive, automated or disproportionate use.
16. Hublyd intellectual property
Hublyd and its licensors retain all intellectual property rights relating to the Services, including software, interfaces, trademarks, logos, databases, graphic elements, texts, methods, documentation, workflows, designs, technical and functional elements. Nothing in the Terms of Use transfers to the Client or users any ownership right over the Services. Any reproduction, adaptation, distribution, extraction, commercial exploitation or unauthorised use of the Services is prohibited.
17. Monitoring, moderation, suspension and deletion
Hublyd does not carry out systematic prior control of Client Content, but may perform limited checks when necessary to ensure proper operation, security, legal compliance, fraud prevention or the handling of a report. Hublyd may remove content, limit a feature, suspend an account, delete an account or terminate access to the Services in the event of a breach of the Terms of Use or Terms of Sale, non-payment, fraud, misuse, unlawful content, security risk, infringement of third-party rights, authority injunction or significant legal or reputational risk.
18. Personal data protection
Processing of personal data by Hublyd is described in the Privacy Policy. Where Hublyd processes personal data on behalf of the Client, the applicable conditions are set out in a Data Processing Addendum, available on request or accessible from the website once published. Certain data stored in the database, in particular client reference data, may be subject to encryption or enhanced protection measures. These measures do not exempt the Client from their own security, confidentiality and compliance obligations.
19. Service evolution
Hublyd may evolve the Services, add, modify, replace or remove certain features, in particular for technical, security, legal, commercial or product-improvement reasons. For paid subscriptions, Hublyd endeavours not to substantially remove essential features of the current subscription, except where required by technical, legal or security constraints.
20. Export control and international use
The Client undertakes to use the Services in compliance with applicable laws, in particular regarding international sanctions, export controls, intellectual property, personal data and protection of confidential information. Certain features may not be available or permitted in all countries.
21. Amendment of the Terms of Use
Hublyd may amend the Terms of Use to reflect changes in the Services, laws, security requirements, business practices or its providers. In the event of a material change, Hublyd will notify users by any appropriate means. Continued use of the Services after the new Terms of Use come into force constitutes acceptance of the new terms. Hublyd may retain successive versions of the Terms of Use that have been accepted or made available.
